GakuNin RDM Validation Test Privacy Policy (Version 1, 1 April 2019)

In this privacy policy (hereinafter called ‘the Policy’), we specify how we deal with privacy information concerning the users who participate in the validation test (from 1 April 2019) for the research data management services (hereinafter called ’GakuNin’. RDM stands for research data management), which is being constructed by the Research Center for Open Science and Data Platform, National Institute of Informatics (hereinafter called ’The Research Center’), Research Organization of Information and Systems (hereinafter called ’The Research Organization’).

Article 1 (Privacy Information)

Among privacy information, the term ‘personal data’ refers to ‘personal data’ as mentioned in Act on the Protection of Personal Information, and means that it is the information about a living individual who can be identified as a specific individual by name, date of birth, address, telephone number, affiliation, contact and other descriptions contained in such information.
Among privacy information, the term ‘history information and attribute information’ refers to information other than ‘personal data’ specified above, and means that it is the information about the history of the services used or pages viewed, keywords searched by a user, time and date of use, usage method, usage environment, postal code, sex, occupation, age, user’s IP address, cookie data, location data, individual identification data of a terminal.

Article 2 (Method of Collecting Privacy Information)

The Research Center may ask for personal information such as name, affiliation, address, telephone number, and email address when a user registers to the services.
When a user uses the Research Center’s services or views its page, the Research Center shall collect history information and attribute information about the user such as the services and software used, history of viewed pages, search keywords searched, time and date of use, usage method, usage environment (including the communication status of the mobile computer used, and the information on various settings at the time of use), IP address, cookie data, location data, individual identification data of the terminal.

Article 3 (Purposes of Collecting and Using Personal Data)

The Research Center’s purposes of collecting and using personal data are as follows:

  1. For the purpose of displaying the registration information such as name, affiliation, address and contact and the information on the services used so that the users can browse and modify their registration information and browse their usage
  2. For the purpose of using the contact information such as name and address in order to inform the users about using their e-mail addresses for notification and communication as required
  3. For the purpose of using the information such as name, affiliation, date of birth, address, telephone number and delivery result of certified mail in order to prove the identity of the users
  4. For the purposes of displaying the information registered to the Research Center on the input screen so that the users can enter their data easily and quickly, and forwarding it to other services (including the ones provided by partners) as instructed by the users
  5. For the purpose of using the information required for the Research Center to provide its services to the users such as the contents of inquiries, usage status of the services by the users and contact information so that the Research Center can handle the users’ inquiries
  6. For the purpose of using the information such as the mode of use, name and address, which help to identify individuals in order to prevent such users, who have violated the Terms of Use of the services (e.g. causing damage to a third party) or who intend to use the services for fraudulent and unjustifiable purposes, from using the services
  7. For the purposes that are associated with the purposes of use prescribed above

Article 4 (Provision of Personal Data to Third Parties)

The Research Center shall not provide personal data to third parties without the consent of the user in advance except in the cases listed below. This, however, saves to the extent that is accepted by the Act on the Protection of Personal Information and other laws and regulations.

  1. Cases based on laws and regulations
  2. Cases that is necessary for the protection of life, body and assets, and besides it is difficult to obtain the consent of the user
  3. Cases that is necessary for the improvement of public health and promotion of healthy development of children, and besides it is difficult to obtain the consent of the user
  4. Cases in which a national agency, local authority or those who received a commission from them requests us to cooperate in order to execute operations set forth in laws and regulations, and besides it may interfere with the execution of the said operations by obtaining the consent of the user

Notwithstanding the conditions of the preceding paragraph, the cases listed below shall not be deemed to be a third party.

  1. Cases in which the Research Center commissions the handling of all or part of personal data to a particular business operator, to the extent that is necessary to achieve the purposes of use
  2. Cases in which personal data is provided in association with a merger or business succession for any other reasons
  3. Cases in which the Research Center uses personal data in cooperation with a particular business operator, with which it signed the confidentiality agreement, for the purposes of the research development for the improvement of its academic information infrastructure services or proving the user supports

(個人情報の開示)

第5条 研究所は、本人から個人情報の開示を求められたときは、本人に対し、これを開示します。ただし、開示することにより次のいずれかに該当する場合は、その全部または一部を開示しないこともあり、開示しない決定をした場合には、その旨を通知します。

一 本人または第三者の生命、身体、財産その他の権利利益を害するおそれがある場合

二 研究所の業務の適正な実施に著しい支障を及ぼすおそれがある場合

三 その他法令に違反することとなる場合

前項の定めにかかわらず、履歴情報および特性情報などの個人情報以外の情報については、開示いたしません。


(個人情報の訂正および削除)

第6条 ユーザーは、研究所の保有する自己の個人情報が誤った情報である場合には、研究所が定める手続きにより、研究所に対して個人情報の訂正または削除を請求することができます。
研究所は、ユーザーから前項の請求を受けてその請求に応じる必要があると判断した場合には、遅滞なく、当該個人情報の訂正または削除を行い、これをユーザーに通知します。


(個人情報の利用停止等)

第7条 研究所は、本人から、個人情報が、利用目的の範囲を超えて取り扱われているという理由、または不正の手段により取得されたものであるという理由により、その利用の停止または消去(以下、「利用停止等」といいます。)を求められた場合には、遅滞なく必要な調査を行い、その結果に基づき、個人情報の利用停止等を行い、その旨本人に通知します。ただし、個人情報の利用停止等に多額の費用を有する場合その他利用停止等を行うことが困難な場合であって、本人の権利利益を保護するために必要なこれに代わるべき措置をとれる場合は、この代替策を講じます。


(プライバシーポリシーの変更)

第8条 本ポリシーの内容は、ユーザーに通知することなく、変更することができるものとします。
研究所が別途定める場合を除いて、変更後のプライバシーポリシーは、本ウェブサイトに掲載したときから効力を生じるものとします。
